Kansas Fights Addiction Act


In 2021, the Kansas Legislature passed the Kansas Fights Addiction Act (HB 2079) to govern the distribution of settlement funds to the state from opioid producers and distributors. Pursuant to this legislation, local governments will be receiving 25% of settlement funds. In order to receive settlement funds, cities will be required to certify costs, agree to spend the funds on lawful purposes, and waive any claims against the settling parties. The League has prepared an informational sheet to help explain these requirements and a sample resolution to certify costs and authorize city officials to enter into the settlement agreements
.

Here is the Memorandum of Understanding (MOU) entered into by the League, the Kansas Association of Counties, and the Attorney General's office as required by HB 2079. You may review the MOU to see the city requirements, how funds will be disbursed, and permissible purposes for which settlement funds can be utilized.

 

Exhibit A Form 
In order to receive settlement funds, ALL CITIES will be required to complete, sign, and submit Exhibit A to the Attorney General's office with the resolution certifying costs and affirming the waiver of claims.

The completed Exhibit A and the resolution can be submitted on the Attorney General’s Opioid page: https://ag.ks.gov/opioids. There you will find a link to a Subdivision Settlement Document Submission Form where you will be required to fill in some information and upload the forms.

There are three fillable fields in the PDF linked above. These fields are requesting the information in the following order; Name of Political Subdivision, Complete Mailing Address, and Date.

 

Exhibit K Forms
Cities with less than 10,000 
in population seeking to receive settlement funds will need to complete Exhibit K forms for the Distributors and Janssen (Johnson & Johnson) settlements. These forms are linked below.

E-mail completed Exhibit K forms to  participation@nationalopioidsettlement.com.
Your city should keep a copy of the completed forms.
